Sean ‘Diddy’ Combs claims he was making “amateur porn” in conviction appeal

Sean ‘Diddy‘ Combs’ lawyers are claiming the rapper created “amateur porn” ahead of a court hearing in his conviction appeal.

Combs appealed his sentence earlier this year, with his attorneys set to appear before a panel of three federal appellate judges on April 9th.

According to TMZ, his legal team are claiming that he made his own porn, which is protected by the US Constitution.

“Freak-offs and hotel nights were highly choreographed sexual performances involving the use of costumes, role play, and staged lighting which were filmed so Combs and his girlfriends could watch this amateur pornography later,” they said.

They added, “Pornography production and viewing of this sort is protected by the First Amendment and thus cannot constitutionally be prosecuted.”

Combs is currently behind bars at FCI Fort Dix in New Jersey. He was sentenced to four years and two months after being found guilty of two counts of transportation to engage in prostitution.

His lawyers previously cited amateur porn in a motion last year. They said, “When considered in its totality, the evidence presented by the government makes clear that Mr Combs’s amateur porn, like many other adult films, was creative, intricate, and highly choreographed.”

They continued, “The videos accordingly have expressive content and are protected by the First Amendment. Mr Combs, at most, paid to engage in voyeurism as part of a ‘swingers’ lifestyle. That does not constitute ‘prostitution’ under a properly limited definition of the statutory term.”

In Combs’ appeal, filed on March 13th, attorneys claimed the rapper was punished by Judge Arun Subramanian for crimes he was cleared of. According to them, his sentence is four times longer than usual for Mann Act convictions.
