A lawsuit has been refiled against Russell Simmons, claiming he pinned down a woman and raped her in his apartment in Manhattan in the mid-1990s. The accuser, a former Def Jam executive, brought the complaint to New York state court on March 13th.

In February, a federal judge dismissed the original suit against the Def Jam Recordings co-founder over jurisdiction issues. Simmons alleged he’s a “stateless” American citizen living on a permanent Indonesian retirement visa in Bali.

Jane Doe initially brought her action in federal court. The woman expects no issues pursuing her claims and told Rolling Stone she’s determined to bring justice.

“For me, his accountability is the paramount reason I filed the case, for Russell to accept he was wrong, that he caused pain,” she said. “Forced sex is against the law. Stop saying the rules are different now; it was wrong then too. I thought the justice system would hold him accountable, and here we are talking about jurisdiction, and I’m watching this legal gamesmanship he plays to avoid it. It just makes me want to push harder.”

Last year, Jane Doe joined more than 20 women who had accused Simmons of sexual assault or harassment. Simmons reached confidential settlements with some but are now suing him with claims he went back on the agreements.

In a statement, her lawyer, Kenya Davis, said, “Russell Simmons has a consistent pattern of doing anything and everything to dodge accountability, like failing to make agreed settlement payments to women and fleeing to Bali to try to sidestep legal action in the United States.”

She continued, “Meanwhile, he avails himself of the US courts when it serves him and his businesses. With today’s filing, we are telling Mr Simmons in no uncertain terms: ‘You can no longer run from justice. The time to answer for your conduct is now.’”
