Cardi B denied motion to dismiss $50 million copyright infringement lawsuit

Cardi B was sued for copyright infringement last year, claiming her song ‘Enough (Miami)’ used the beat from the Reservation Dogs series without permission. The Bronx rapper recently attempted to dismiss the lawsuit, but her request has been denied.

Cardi’s legal team alleged the songs aren’t substantially similar. At a hearing on June 17th, US District Judge Fred Biery disagreed, saying “the court finds plaintiffs have alleged sufficient facts to state a claim for copyright infringement.”

Joshua Fraustro and Miguel Aguilar, better known as Kemika1956, named Cardi, producers OG Parker and DJ SwanQo, Atlantic Records and Warner Music Group as co-defendants.

Kemika1956 released a track called ‘Greasy Frybread‘ in 2021 with Punkin’ Lusty, a character played by actor Sten Joddi in the FX show. They claim it has a similar beat to ‘Enough (Miami)’.

The lawsuit, filed in a Texas federal court, stated, “This civil action seeks damages and injunctive relief for multiple claims including copyright infringement, vicarious infringement, contributory infringement, unfair competition, and misappropriation.”

They also asked for a temporary restraining order on the track and the destruction of all infringing copies of the record.

Cardi was previously sued alongside Megan Thee Stallion over their hit single ‘WAP’ in 2023 and came out victorious.

On June 20th, she returned with her new single ‘Outside‘, serving as her first single of 2025. In the song, Cardi touches on the end of her relationship with Offset. She raps, “I’ve been cuffed up too long, let me remind n*ggas/ Your favourite player on your favourite team, he in my DM.”

Earlier this month, she confirmed she was in a relationship with NFL star Stefon Diggs while divorce proceedings are ongoing.
