Members Only sue Drake for trademark infringement

Drake has spent most of this year in the headlines. The Canadian rapper has been beefing with Kendrick Lamar but is now in the crosshairs of a giant company, as Members Only is attempting to sue the performer.

XXL have obtained court documents that the fashion brand, famed for their unique jackets, Members Only is suing Drake’s touring company Away From Home Touring Inc., for infringing on its trademark.

The lawsuit was filed on June 11th in New York federal court. The documents allege that the merchandise being sold on the It’s All a Blur Tour violated the trademarks held by Members Only.

Usually, such a case would be in regards to somebody selling counterfeit merchandise, however, this time it is different. They claim that the t-shirts being sold by Drizzy’s team infringe upon their trademark by featuring the words “Members Only” on the front.

In their complaint, JR Apparel World LLC, the current owner of the Members Only brand, argued that even though the “Members Only” logo on the shirts refers to Drake’s song from his latest album For All the Dogs, it does not eliminate the likelihood of confusion.

Furthermore, it does not grant Live Nation (which supported the tour) or Drake the right to use the Members Only trademark in a way that causes confusion, especially on or in connection with clothing items.

The suit suggests that fans will be confused and think that the Members Only brand is affiliated with Drake. JR Apparel claim they have tried to amicably resolve the situation on numerous occasions to no avail.
